Fast Track Citizenship Application Adjudication Witnessed

infoImmigration adjudication process for certain types of cases that require security background and name check have always been notoriously prolonged in the past, due to the extremely slow process or rather sometimes no-process at FBI.  We have seen extreme examples including an adjustment of status application (I-485 for "green card") pending with USCIS for over 5 years, primarily due to the reason that the USCIS did not receive the required fingerprint check result from FBI.  There were many legal actions in form of “writ of mandamus” litigations filed against both USCIS and FBI in various federal courts across the nation, as a result.  That was the background and history.

H-1B Employers Getting Surprise Visit by US Immigration Agents

infoIt has come to our attention that recently some of our H-1B clients have been visited by the US Citizenship & Immigration Service (USCIS), all started with a surprise visit by an investigator from the USCIS, regarding certain previously approved H-1B cases, under a special procedure of Administrative Site Visit and Verification Program (ASVVP) for H-1B visa assessment.

Honorably Discharged US National Guard Soldier Faces Deportation!

infoA former US national guard honorably discharged soldier has been apparently served by the US immigration authorities a “Notice to Appear,” a/k/a: NTA which is a charging document issued by the government to all deportable or removable aliens including lawful permanent resident or "green card" holders (collectively known as “respondents”) with a list of alleged grounds for deportation or removal and in our jargon called “deportability” or “removability.”

Supreme Court Asked Obama Administration for Positions On Hiring Illegal Aliens

infoThe US Supreme Court asked the White House today for its views on the state legislation that imposes penalties against employers hiring illegal aliens.

Supreme Court is to rule on a case with landmark impact on deportation cases!

infoYesterday, the Supreme Court heard arguments in a Kentucky case that raised questions about whether defense attorneys have a constitutional duty to tell their clients about how guilty pleas in a criminal case might affect their other rights and privileges, including consequences affecting their immigration status or risks of being deported.
