In order for us to give you the best opinion, it is important that you provide us the best background information regarding your case. Generally, there are two types of I-140 or immigrant petitions: 1. Immigrant petition with an approved "alien labor certification" (now commonly referred to as "PERM") and in such a case, the I-140 must be accompanied by a certified PERM from the Department of Labor (DOL) first. 2. Immigrant petition without PERM or direct I-140 either because PERM requirement is statutorily exempt (such as "alien of extraordinary ability" or "ourstanding professor/advanced researcher" or "multinational business executives" or the required is waived in "national interest" (NIW). In such a situation, an I-140 can be filed without the need of an approved or certified PERM.
